Terms of Service

Last updated October 16, 2026

These terms are an agreement between you and Matagorda Studio LLC ("we", "us"), a Texas limited liability company that runs EscBooks. They cover your use of the EscBooks website, web app and related services (together, "EscBooks" or the "Service").

By creating an account or using EscBooks, you agree to these terms and to our Privacy Policy and Refund Policy. If you're using EscBooks for a business, you agree on behalf of that business, and "you" means both you and it.

1. What EscBooks is

EscBooks is online software for people who bill for their time. You can use it to track time, send estimates and invoices, manage retainers, record expenses and equipment, keep track of subscriptions and vendors, and run reports.

We keep improving EscBooks, which means features may change, and some may be added or removed. If we remove something important to the plan you pay for, we'll tell you ahead of time.

2. Your account

  • You must be at least 18 years old and able to enter into a contract.
  • Give us accurate information when you sign up, and keep it up to date.
  • Keep your password safe. You're responsible for what happens under your account. Tell us right away at support@escbooks.com if you think someone else has gotten in.
  • A Solo plan is for one person. Don't share your sign-in with others.

3. Free trial, plans and billing

Free trial. New accounts start with a 30-day free trial. We ask for a payment card when you start, but we don't charge it during the trial. If you don't cancel before the trial ends, your paid plan begins and your card is charged automatically. Each business gets one free trial.

Plans and renewal. The Solo plan costs $14.99 per month or $129 per year, plus any applicable taxes. Your plan renews automatically at the end of each billing period, and we charge the card on file, until you cancel.

Price changes. If we change the price of your plan, we'll email you at least 30 days before the new price applies. The change takes effect at your next renewal after that notice. You can cancel before then if you don't want to continue.

Failed payments. If a charge fails, our payment processor will retry it. Your account stays open while that happens. If we still can't collect payment, we may suspend access to your account until the balance is paid.

Canceling. You can cancel at any time from Settings → Plan & Billing. Your plan stays active until the end of the period you've paid for, and then it won't renew. Refunds are covered by our Refund Policy.

Payment processing. Payments are processed by Stripe. Your card details go directly to Stripe and are never stored on our servers. Stripe's own terms and privacy policy also apply to your payment information.

4. Your data

Everything you put into EscBooks stays yours. That includes your clients, time entries, invoices, expenses, receipts, logos and everything else (your "Data"). You give us permission to store, process and display your Data only as needed to run the Service for you: for example, to show it to you, turn it into PDFs, and send the emails you ask us to send. We don't sell your Data.

You're responsible for your Data and for having the right to put it into EscBooks. This includes information about your clients and contractors. If you enter someone else's personal information, you're responsible for having a lawful basis to do so and for telling them about it where the law requires.

You can download reports and documents from EscBooks at any time. We take reasonable steps to protect and back up your Data. Still, you should keep your own copies of records you're required to keep, such as tax records.

5. Invoices, emails and getting paid

  • When you send an invoice, estimate, reminder or statement through EscBooks, we deliver it on your behalf. You're responsible for its content, its accuracy, and for sending it only to people who expect to hear from you.
  • EscBooks doesn't collect or hold money for you. Your clients pay you directly, through the payment link or bank details you add. Any payment service you link to, such as Stripe, PayPal or your bank, is between you and that provider.
  • EscBooks records the payments you enter so your books are up to date. It doesn't move money.

6. Not tax, legal or accounting advice

EscBooks helps you organize your numbers. It isn't an accountant, tax preparer or lawyer. Reports, tax estimates, set-aside suggestions, depreciation schedules, 1099 summaries and any guides in the app are provided for your information only. They aren't professional advice. Tax rules change and depend on your situation, so check with a qualified professional before relying on them.

7. Acceptable use

You agree not to:

  • Use EscBooks for anything illegal, fraudulent or deceptive, including fake invoices or phishing.
  • Send spam or unwanted messages through the Service.
  • Upload malware or content that infringes someone else's rights.
  • Try to get into accounts or data that aren't yours, probe or break our security, or put an unreasonable load on our systems, including through scraping or automated access we haven't allowed.
  • Copy, resell or reverse engineer the Service, or use it to build a competing product.

8. Other services and connected assistants

EscBooks relies on, and can link to, services run by other companies. If you connect an outside service, such as an AI assistant you allow to work with your books, you're choosing to let it access your account within the permissions you approve. You're responsible for what you approve, and you can disconnect it at any time. We aren't responsible for services we don't run, and their own terms apply to your use of them.

9. Availability

We work to keep EscBooks running and fast, but we can't promise it will always be available or free of errors. We may need to pause it for maintenance, and it can be affected by things outside our control, including outages at the providers we rely on.

10. Ending your use

You can stop using EscBooks at any time. To have your account and Data deleted, email us at support@escbooks.com. Our Privacy Policy explains what happens to your Data after you cancel or ask for deletion.

We may suspend or close your account if you seriously or repeatedly break these terms, don't pay, or use EscBooks in a way that could harm us, other users or the public. Unless the law or the situation prevents it, we'll tell you first and give you a reasonable chance to download your Data.

11. Disclaimers

EscBooks is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will meet every need you have or that calculations will be free of errors. Check important figures before relying on them.

12. Limitation of liability

To the fullest extent the law allows, Matagorda Studio LLC won't be liable for any indirect, incidental, special, consequential or punitive damages. Nor will we be liable for lost profits, revenue, data or business opportunities, arising out of or related to your use of EscBooks. This applies even if we were told such damages were possible.

Our total liability for any claim related to EscBooks is limited to the amount you paid us for the Service in the 12 months before the claim arose. Some places don't allow these limits, so they may not fully apply to you.

13. Indemnity

If a third party makes a claim against us because of your Data, the documents you send, or your breach of these terms or of the law, you agree to cover our reasonable losses and costs from that claim, including reasonable legal fees.

14. Governing law and disputes

These terms are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules. If a dispute comes up, please contact us first at support@escbooks.com. Most issues can be sorted out quickly that way. If we can't resolve it informally within 30 days, either of us may bring the dispute in the state or federal courts located in Texas, and we both consent to their jurisdiction. Either of us may also bring an individual claim in small claims court instead.

15. Changes to these terms

We may update these terms from time to time. If a change is significant, we'll let you know by email or in the app at least 30 days before it takes effect. If you keep using EscBooks after that, you accept the new terms. If you don't agree, you can cancel before they apply.

16. General

  • These terms, together with the Privacy Policy and Refund Policy, are the whole agreement between you and us about EscBooks.
  • If any part of these terms can't be enforced, the rest still applies.
  • If we don't enforce a right right away, we haven't given it up.
  • You may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or sale of the business.
